Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the BidMyMove platform, including our website, mobile application, and all associated services (collectively, the "Platform"), operated by BidMyMove (Pty) Ltd, a company registered in the Republic of South Africa ("BidMyMove", "we", "us", or "our").

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and any other policies published on the Platform. If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and BidMyMove. If you are using the Platform on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall include both the individual user and the entity you represent.

2. Definitions

In these Terms, the following definitions apply:

  • "Customer" means any individual or business that uses the Platform to request a moving or logistics service.
  • "Driver" / "Transport Provider" means any verified individual or business that uses the Platform to offer transport and logistics services.
  • "Booking" means a confirmed agreement between a Customer and a Transport Provider for the provision of a move or transport service, facilitated through the Platform.
  • "Bid" means a quotation submitted by a Transport Provider in response to a Customer's move request.
  • "Platform" means the BidMyMove website, mobile application, and all associated services.
  • "User" means any person who accesses or uses the Platform, including Customers and Transport Providers.
  • "Move Request" means a request submitted by a Customer on the Platform describing the services required.

3. The Nature of BidMyMove's Role

BidMyMove operates as a technology marketplace and facilitates connections between Customers and independent Transport Providers. BidMyMove is not a transport company and does not itself provide moving or logistics services.

BidMyMove does not employ Transport Providers, and Transport Providers are independent contractors who use the Platform to find and fulfil work. The contract for the provision of moving services is formed directly between the Customer and the Transport Provider upon acceptance of a Bid.

BidMyMove's role is limited to:

  • Operating and maintaining the Platform
  • Facilitating the bidding and booking process
  • Processing payments on behalf of the parties
  • Providing tracking and communication tools
  • Offering customer support and dispute resolution

BidMyMove is not a party to the service agreement between a Customer and a Transport Provider and is not liable for the acts, omissions, negligence, or misconduct of any Transport Provider.

4. Eligibility and Registration

4.1 You must be at least 18 years of age to use the Platform. By registering, you confirm that you meet this requirement.

4.2 You must provide accurate, current, and complete information when creating an account and must keep this information updated.

4.3 You are responsible for maintaining the security and confidentiality of your account credentials. You must notify us immediately if you suspect any unauthorised access to your account.

4.4 BidMyMove reserves the right to suspend or terminate any account where false, misleading, or fraudulent information has been provided.

5. Move Requests and Bidding

5.1 Customers may submit Move Requests by completing the required fields on the Platform. Move Requests must accurately describe the goods to be moved, the locations involved, and any special requirements.

5.2 Submitting a Move Request does not create any obligation on the Customer to accept any Bid.

5.3 Transport Providers may submit Bids in response to Move Requests. Bids must be accurate, include all applicable costs, and reflect the actual services the Transport Provider intends to provide.

5.4 A Booking is formed when a Customer accepts a Bid. Once a Booking is confirmed, both the Customer and the Transport Provider are bound by the agreed terms.

5.5 BidMyMove does not guarantee that any Move Request will receive Bids, or that any particular Bid will meet the Customer's requirements.

6. Customers — Obligations and Responsibilities

6.1 Customers must ensure that all items to be moved are accurately described in the Move Request. Failure to disclose relevant information (such as items requiring specialist handling, access restrictions, or hazardous materials) may result in additional costs or cancellation.

6.2 Customers must ensure that pickup and delivery locations are accessible at the agreed time. Unreasonable delays caused by the Customer may result in additional charges as agreed with the Transport Provider.

6.3 Customers must not attempt to book Transport Providers for services that are unlawful, including the transport of prohibited or restricted goods under South African law.

6.4 Customers are responsible for ensuring that goods being transported comply with all applicable laws and regulations, including customs requirements for cross-border transport.

7. Transport Providers — Obligations and Responsibilities

7.1 Transport Providers must complete the BidMyMove verification process before submitting Bids or accepting Bookings. This includes the provision of valid documentation, including but not limited to driver's licence, professional driving permit (where required by law), vehicle registration, and roadworthy certification.

7.2 Transport Providers must ensure that their vehicles are roadworthy, appropriately licensed, and compliant with all applicable South African road traffic legislation, including the National Road Traffic Act 93 of 1996.

7.3 Transport Providers must honour all confirmed Bookings. Cancellations by Transport Providers after a Booking is confirmed may result in suspension or removal from the Platform.

7.4 Transport Providers are responsible for obtaining appropriate insurance coverage for their vehicles and for goods in transit. BidMyMove does not provide insurance coverage.

7.5 Transport Providers must conduct themselves professionally and treat Customers with courtesy and respect at all times.

8. Prohibited Conduct

The following conduct is strictly prohibited on the Platform:

  • Submitting false, misleading, or fraudulent information
  • Attempting to circumvent the Platform's payment system by transacting directly with a party introduced through BidMyMove
  • Posting or transmitting unlawful, defamatory, abusive, or harmful content
  • Offering or requesting the transport of prohibited or dangerous goods
  • Soliciting personal information from other users for unauthorised purposes
  • Using automated tools or bots to access or interact with the Platform
  • Engaging in any conduct that could damage the reputation or integrity of BidMyMove or any other user

9. Payments

9.1 All payments for services booked through BidMyMove must be processed through the Platform's approved payment system.

9.2 Upon booking confirmation, the agreed amount is held securely and released to the Transport Provider upon successful completion and confirmation of the service.

9.3 BidMyMove may charge a service fee, which will be clearly disclosed to both parties prior to booking confirmation.

9.4 Customers must ensure that their payment method is valid and that sufficient funds are available at the time of booking.

9.5 Attempting to circumvent the Platform's payment process is a material breach of these Terms and may result in immediate account suspension and legal action.

10. Cancellations and Refunds

Cancellations and refunds are governed by BidMyMove's Refund Policy, which forms part of these Terms. Please refer to the Refund Policy section for full details.

11. Dispute Resolution

11.1 BidMyMove provides a dispute resolution process to assist Customers and Transport Providers in resolving disagreements arising from Bookings.

11.2 In the event of a dispute, either party may contact BidMyMove's support team, who will facilitate communication between the parties and assist in reaching a fair resolution.

11.3 BidMyMove's decision in dispute resolution processes is advisory. Where parties cannot resolve a dispute through BidMyMove's process, they may seek resolution through the appropriate South African legal channels, including the National Consumer Commission under the Consumer Protection Act 68 of 2008.

11.4 BidMyMove is not an arbitrator and is not responsible for the outcome of any dispute between a Customer and a Transport Provider.

12. Liability

12.1 BidMyMove provides the Platform on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

12.2 To the maximum extent permitted by South African law, BidMyMove shall not be liable for:

  • Any loss, damage, or theft of goods during transport
  • Any loss arising from the acts or omissions of Transport Providers
  • Any indirect, consequential, or special loss arising from use of the Platform
  • Any loss arising from system downtime, technical errors, or payment failures beyond our reasonable control

12.3 Nothing in these Terms excludes or limits any liability that cannot be excluded under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation.

12.4 Where BidMyMove is found liable, our total aggregate liability to you shall not exceed the amount of the transaction fees paid by you to BidMyMove in the 3 months preceding the relevant claim.

13. Intellectual Property

All content on the BidMyMove Platform, including the name, logo, design, software, text, and graphics, is owned by or licensed to BidMyMove and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

14. Termination

14.1 You may close your account at any time by contacting us.

14.2 BidMyMove reserves the right to suspend or terminate your account at any time, with or without notice, where you have breached these Terms, engaged in fraudulent or unlawful conduct, or where your use of the Platform poses a risk to other users or to the integrity of the Platform.

14.3 Upon termination, outstanding payment obligations remain enforceable.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

16. Consumer Protection

BidMyMove acknowledges its obligations under the Consumer Protection Act 68 of 2008 (CPA). Nothing in these Terms is intended to limit, waive, or exclude any right afforded to consumers under the CPA. In the event of a conflict between these Terms and the CPA, the CPA shall prevail.

17. Changes to These Terms

BidMyMove reserves the right to update or modify these Terms at any time. We will notify you of material changes through the Platform or by email. Your continued use of the Platform after such notification constitutes acceptance of the updated Terms.
